Notary Appointment Preparation Checklist

Following this checklist is the single best way to avoid a failed appointment — especially for signers who are elderly, in memory care, or in a hospital or facility setting.

1. ID Requirements

  • Government-issued photo ID must be physically present — not a copy or a photo on a phone.
  • ID must be unexpired.
  • The name on the document must match the ID (or the ID must contain a fuller version of the same name).
  • Acceptable forms of ID: U.S. Driver's License, State ID Card, U.S. Passport, or a Foreign Passport stamped by USCIS.

2. Signer Competency & Capacity

Florida law prohibits notarization if the signer appears impaired or coerced. At the time of signing, the signer must:

  • Be alert, oriented, and awake.
  • Understand the general purpose of the document.
  • Act voluntarily, free from coercion.
  • Be able to physically communicate intent (verbally or non-verbally).

3. Document Readiness

  • The document should be completely filled out — no blank spaces.
  • All pages should be present, not just the signature page.
  • Do not pre-sign. Signatures must be witnessed by the notary at the appointment.
  • Any multiple-choice elections (e.g., Living Will options) should already be made.

4. Witness Requirements

Many documents — including Wills and Healthcare Directives — require witnesses in addition to the notary, typically two. Witnesses must be:

  • Adults (18+) with valid photo ID.
  • Disinterested — meaning they receive no benefit from the document, are not named in it, and are not closely related to the signer.
  • Present for the entire signing.

5. Setting Up the Space

  • Have a hard writing surface available.
  • Choose a well-lit room.
  • Keep the environment relatively quiet — an oath or affirmation may need to be spoken aloud.
  • If in a facility, make sure staff have been notified of the notary's visit.
